|| general terms ⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯

＊ By commissioning me, you're automatically agreeing to my Terms of Service.＊ You must be 18 years of age to order a commission. I do not accept applications from minor's legal guardians.＊ My art is and always will be fluid and experimental. I find it very hard to use the same brushes, colors or technique with each piece. On top of that i work on Clip Studio Paint and Procreate interchangeably.
For my most recent & up to date examples check my socials!＊ I do not work with deadlines by default, but I will give a brief estimate at which the commission will be completed (usually no longer than 2 months depending on the artwork's complexity and the size of my queue).＊ I retain copyright to all of my artwork. You are prohibited from using my artwork in any way that profits you (be it monetarily/exposure etc.).＊ The client is prohibited from sharing the commissioned piece without my watermark/proper credit. I also do not allow reposts on the following sites: Facebook, Threads, VK, Patreon (or any other pay-to-view site), DeviantArt and Amino.＊ My artwork may not be used to create NFTs or anything else crypto-related. I do not consent for my art to be reproduced/scraped for data by any AI-related or similar technology.

Commission applications happen via google forms where you can fill your application.If you're interested in a commission not mentioned on my site, you're welcome to send me an email for further discussion or a custom quote.Once your initial application is reviewed and confirmed, you're expected to contact me within 48 hours to confirm. If you fail to meet this deadline your commission slot will go to another person.My openings are irregular, but I try my best to open at least once every 2 months.

＊ payment ⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯

Payment in EUR only via PayPal invoice. * In special cases I might require payments via ko-fi or stripe. *Full payment is expected upfront for any type of commission unless a payment plan has been discussed and agreed upon beforehand.The client is expected to pay within 24 hours of receiving the invoice or the slot will not be secured and will be given to another person.I do not accept payments made via e-checks. Any payment made via an e-check will be immediately refunded and the slot will be given to another person. I am not responsible for the timeframe at which your refund will arrive as it is out of my hands by that point.I may apply a complexity fee to some commissions if the character requested has complicated markings or a high number of colors. I will notify of the fee before payment.Payment plans become available for commissions priced €300 and over.
If a payment plan has been agreed upon, a non-refundable downpayment of %17 of the price is required upfront.After the first draft has been sent for approval, I will not continue working on the commission until I receive the rest of the payment which is expected to be fully paid within 14 days of sending the downpayment. * Keep this in mind during application process as this deadline will not be extended. *In case of a payment plan, the client will not receive full res/unwatermarked files until the full payment has been received.If the client doesn't complete the payment within the agreed timeframe, I retain all permissions to the commissioned artwork and its future use and application.

＊ timeframe ⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯

I work based on a monthly/ bi-weekly timeframe depending on the batch size and complexity of the commissions accepted.
You can expect the first draft to be sent within the first two weeks of order confirmation.Depending on the size of my queue, the client can expect the finished product to be completed within one month, however in rare cases this estimate can extend up to two months.
I am not responsible for any delays caused by the lack of or delayed communication on the client's behalf.In case I won't hear back from a client for longer than a month of sending a draft during any progress stage, the commission will be cancelled and the client will receive a partial refund based on the progress made on their commission.If the client warns me that there will be a specific time of no communication between me and the client for any given reason - be it a personal situation, holidays etc.- the above does not apply.Any information about my absence/ hiatus will be communicated either directly to the client, through my Trello or my commission channel on Telegram.To check where you're seated on my queue, please visit my public Trello.The client may request a specific deadline for the commissioned piece's completion for an additional rush fee of 20% of the total price. This price in non-negotiable.

＊ delivery ⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯

The finished unwatermarked artwork will be shared through a Google Drive link sent by email or any other preferred way of contact.The files will include a high res PNG file alongside resized versions of the artwork suitable for sharing on social media.I won't keep the original PDF file for longer than a week, so it is the client's responsibility to make sure their copy is secured. I do not offer edits past this point.The finished artwork is always digital and I do not offer physical copies.

＊ revisions ⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯

Commission price includes 3 revisions on any stage of the process. This doesn't include revisions related to me overlooking a character/prompt detail clearly visible or stated on the reference material provided by the client. In this case the revisions are free.If you notice there's something that needs to be fixed, please communicate that as soon as possible. If the requested change could have been made in the earlier stages of the process I may apply an additional fee.

The client must be 18 years of age to commission me.
I retain the right to ask the client to legally confirm their age.I do not accept applications from underage person's legal guardian.All information concerning the commission will be discussed over my private business email with no third parties involved.
I will temporarily store the client's contact information (name and email address) and PayPal address that will be used for the invoice.
This information will be removed after the work has been completed and delivered.

I retain all the copyright to my work as well as the right to showcase it in my online galleries, social media platforms, portfolio, Patreon etc.Illustration commissions are for personal use only by default.I do not allow editing of my artwork with the exception of cropping/resizing/shifting hue or very minor edits (example: subtle change to the character's markings) by the commissioner only.You may upload the commissioned artwork to your social media (with proper credit in the form of a link to any of my sites or socials) with the exception of websites mentioned in the general section of my TOS.If reposting the commissioned piece to Toyhou.se, credit me using the on-site option as "applejuuc".I do not consent to my artwork being used by/associated with any AI related technology or content.

＊ commercial use ⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯

Illustrations for commercial use have to be discussed before payment is made as there will be a commercial fee of +350% of the price added. Illustrations for commercial use must be declared upon commission acceptance, I will not be accepting commercial use requests after the payment has been made or the piece completed.You are not allowed to reproduce or edit the commissioned piece for profit of any form without my agreement and a license you have paid for.

|| refunds & cancellation ⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯

A client is entitled to a full or partial refund (depending on the progress made on the commissioned artwork) only in the case of me not finishing the commissioned piece within the agreed timeframe.
For that reason, please make sure you can afford the commission before sending an application. I will not be held responsible for others poor financial choices.If you'd like to request a refund that you're entitled to according to my Terms of Service, contact me via email with a title "Refund request" with your information/ link to your commission block on my Trello.I reserve the right to spend the commission money immediately after receiving payment. Art is my only way of income and I need to support myself and my family. This does not mean I won't be able to afford a refund if the client requests one, but there will be a 3 week wait period for a refund request to be fulfilled.

PayPal chargebacks are not tolerated and the person responsible will be put permanently on my private blacklist.I'm always open to work something out with the client regarding a refund even if you're not entitled to one according to these terms.

＊ Upon purchasing/commissioning a character design from me, you are free to do anything you'd like with them with a few exceptions like commercial use mentioned in the permissions and license section and using my designs to spread bigoted/hateful messages.＊ I retain the rights to my artwork! This means you may not profit off of or edit the original artwork of the design. You may create a copy of the file to edit, but the original image must be kept in tact (that also means you may not remove the design nor the original file from toyhou.se)

|| ownership & transfers
⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯⎯

＊ You can gift/trade/resell my designs. Traded designs can only be sold if there was extra art made during your ownership.＊ Designs received via trade can still be resold as long as there's been at least one piece of artwork made during your ownership.＊ You can sell my designs for more than their original worth preferably after extra artwork has been made of the design, but it's not strict.＊ Co-ownership of my designs is allowed, but you may not make additional profiles for the design. I do not solve disputes regarding co-ownership.＊ Ownership of my design outside of toyhou.se is allowed as long as the original profile is not removed. If you are purchasing a design for someone who doesn't have a toyhou.se account you can store it on your own. Alternatively i can offer to either store the original profile on my account or provide the person with an invite code so they can make an account.
